Find out the reason for the ban on entry into the Schengen zone. Request to SIS

The European Union is one of the most economically developed international unions in the world. And, of course, many want to come to the EU countries to live, get an education, and open a business.

Into the structure of the European Union, there is the Schengen zone, these are 29 states within the European Union that have cancelled border controls, for identity verification at airports, a passport or identification card of an EU member state or a country that has signed the Schengen agreement may be required.

However, if there are grounds that we will discuss in the article, a ban on entry into the Schengen zone may be established. We will tell you how to find out whether there is such a ban and what the reasons may be.

Schengen Information System

To control migration in the European Union, there is a unified information database of people.

Schengen Information System (SIS) is a large database of information exchange between the countries of the European Union and Schengen. It was introduced in 1995 after the cancellation of controls at internal borders.

The database currently contains information about more than 15 million people.

Since April 2013, SIS contains data on all third-country citizens (non-Schengen and/or EU) who live within Schengen countries or who have received Schengen visas or crossed borders.

The work of SIS is regulated by the following law of the European Union: Regulation (EU) 2018/1861 of the European Parliament and of the Council of 28 November 2018 on the establishment, operation and use of the Schengen Information System (SIS) in the field of border checks, and amending the Convention implementing the Schengen Agreement, and amending and repealing Regulation (EC) No 1987/2006

According to this law, a person who wants to enter the Schengen zone can request information about himself, and member states of the Schengen zone must keep this information as confidential.

We can help you find out if there is a ban on entry into the Schengen area. We have extensive experience in working on migration law, including with the European Union, and will help you write a legal request to SIS.

Reasons for the ban on entry into the Schengen area

European Union legislation establishes the following reasons for a ban on entry into the Schengen zone:

  1. Accused of committing a crime;
  2. Convicted of committing a crime;
  3. Violation of the terms of stay;
  4. Fines, non-payment of fees and duties;
  5. False documents.

There are more reasons for an entry ban, we have talked about the most popular ones. However, it is worth remembering that our first goal is to obtain data from the SIS.

Request to SIS. Where to write and what to do?

Of course, foreigners immediately have a question about how to find out the reason for the ban on entry into the Schengen zone.

In each country participating in the Schengen area there is an authority that works with the database of this SIS. We need the government authority of the country where the person is going to travel.

The first thing to do is to find an authority in the country that works with SIS. It is worth noting that here you will need the help of a specialist; without knowledge of European legislation, this will be quite difficult.

We will tell you using the example of Germany.

In Germany, the authority that works with SIS is the Federal Criminal Police Office (Bundeskriminalamt).

Next, we need to find the contact details of the authority. To do this, you need to go to the official website and find the “contacts” section. Here’s an example.

To write a request, we need a name, address, country, a phone number or fax number will be useful too.

For example:

Bundeskriminalamt

65173 Wiesbaden

Tel.: +49(0)611/55-0

Fax: +49(0)611/55-12141

17.06.2024.

Germany

We write a request to obtain information from SIS

So, we have found the necessary authority, found contact information, which means half the way has been completed.

We recommend dividing the request into several parts, it should be understandable for an employee of a foreign government authority.

Step 1

We must write the contact details of the authority where we are sending the request, we recommend writing them in the upper right corner. Also, we write the date on the left.

In the center we write the name of our document – Request for information from Schengen Information System

Next, we write an official appeal (Dear Sir/Madam,)

Step 2

We refer to European Union law which gives us the right to request information from an authority.

In accordance with Regulation (EU) 2018/1861 of the European Parliament and of the Council of 28 November 2018 on the establishment, operation and use of the Schengen Information System (SIS) in the field of border checks, and amending the Convention implementing the Schengen Agreement, and amending and repealing Regulation (EC) No 1987/2006,

Step 3

Next, we must explain what we want to receive from the authority.

Here you also need to write the applicant’s contact information. This:

  1. First and last name;
  2. Date of birth;
  3. Citizenship;
  4. Number of foreign passport or national passport;
  5. Place of birth.

Our goal is for the authority to be able to identify you and find you in the SIS database.

In the same section, we ask you to give us information about the presence of a ban on entry into the country ______ from the Schengen Information System (SIS).

Write an email address where the authority can send a response.

At the end of our request we need to put a signature. And be sure to attach a scan of the document you wrote about.

Step 4

Next you need to send a request. In some cases, this can be done through a form on the government website. It is also possible by post service.

To increase your chance of a response, you can submit using both methods. By mail we write the address of the authority from the contact information on the website.

We receive a response from the authorities

The last thing you need to do is wait for a response from the foreign authority. Employees will look at the SIS database and tell you whether there is a ban on entry into the Schengen zone.

Use our instructions, contact lawyers, and you will succeed!
